Probate is the formal legal process that gives recognition to a will and appoints the executor or personal representative who will administer a deceased persons property for their creditors and potential heirs in order to distribute assets to the intended beneficiaries according to the laws of the State of Mississippi.
During Probate in Mississippi, the Chancery Court will oversee the distribution of the deceased persons assets and liabilities including any Real Estate they may have owned. If the deceased person owned Real Estate that needs to be sold, the Real Estate will typically be sold through approval by the Chancery Court.
The Probate process in Mississippi involves:
- Validating the will
- Appointing an executor to handle the estate
- Dispersing the estate among heirs Paying outstanding debts
- Filling final government taxes
The Probate process can typically take between 4 months to 1 year depending on the size of the estate and if the Real Estate must be sold to pay the debts.
A Chancery Court Judge oversees the probate process.
A personal representative or executor must initiate probate with the county court of the decedent’s residence.
If the decedent dies without a will, the probate court will assign an executor to distribute assets to the heirs.
